kAGAN general Terms And Conditions for Travel Services

1. General Provisions

1. General Provisions

1.1. These Terms and Conditions (“Terms”) apply to the relationship between KAGAN and anyone who books a tour (“Client”, “you”).

1.2. By submitting a tour booking request, the Client confirms that they have read and accepted these Terms and agree to follow them.

1.3. If the Client does not agree with any part of these Terms, they should not book a tour with KAGAN.

2. Booking and Payment

2.1. A tour is considered booked once the Client has paid the required deposit. The deposit amount and payment instructions will be provided by KAGAN during the booking process. The Client’s place is not reserved until the deposit has been received.

2.2. To make a booking, the Client must provide KAGAN with:

— a scanned copy or clear photo of the identity page of their passport;

— residential address;

— email address;

— WhatsApp phone number for communication.

2.3. The full tour price can be paid by bank transfer, bank card, or cash.

2.4. KAGAN will provide an official invoice for the deposit with the full bank details, authorized signature, and KAGAN stamp. Payment of the deposit against this invoice confirms the booking, provided that the requirements of Section 2 are met.

3. Changes and Cancellation

3.1. Changing tour dates. The Client may request a change of tour dates by notifying KAGAN at least 2 (two) weeks before the tour starts. A date change is subject to availability.

3.2. Cancellation by the Client. If the Client cancels their booking, the deposit is non-refundable. KAGAN may offer to move the booking to different dates or to the following year.

3.3. Leaving the tour early. If the Client decides to leave the tour before it ends:

3.3.1. For groups of 2–5 people, KAGAN may refund the remaining amount for the unused days.

3.3.2. For groups of 6–12 people, no refund will be provided for the unused days.

3.4. Changing the itinerary during the tour. If the Client wants to change the itinerary during the tour, KAGAN will do its best to accommodate the request within the agreed tour budget. Any additional costs resulting from the changes must be paid by the Client.

4. Liability

4.1. KAGAN is responsible for fulfilling the services and obligations included in the tour program confirmed by the Client.

4.1.2. KAGAN is responsible for baggage that is lost, damaged, or delayed by transport carriers during the tour.

4.2. KAGAN is not responsible for:

— adverse weather conditions;

— road or mountain pass closures, including mudflows;

— decisions or actions of government or border authorities;

— baggage that is lost, damaged, or delayed by carriers outside the Kyrgyz Republic.

4.3. KAGAN is not responsible for injuries sustained by the Client during the tour, the Client’s insurance coverage or lack thereof, psychological difficulties experienced during the tour, or allergic reactions.

4.4. KAGAN does not cover injuries or other consequences resulting from falling from a horse. KAGAN will provide appropriate safety conditions and select suitable, healthy horses. However, KAGAN cannot guarantee how an animal may behave in a particular situation.

4.5. If an incident occurs, KAGAN will provide reasonable initial assistance within its capabilities.

4.6. In an emergency, KAGAN may arrange additional assistance, including transportation by vehicle or horse in mountainous areas, where reasonably possible.

4.7. The Client must provide KAGAN in advance with complete and accurate information about their health, dietary requirements, and psychological condition. The Client is also responsible for bringing any medication they may need during the tour.

4.8. The Client is responsible for:

— having a valid passport and all required visas and entry permits;

— following the laws, rules, and customs of the Kyrgyz Republic;

— ensuring that they are physically fit and medically able to participate in the tour;

— reading and understanding the tour program in advance;

— bringing all necessary equipment and personal gear, including suitable clothing, footwear, and medication.

5. Force Majeure

5.1. KAGAN is not responsible for failure or delays in providing services when caused by circumstances beyond its reasonable control, including:

— natural disasters such as earthquakes, floods, mudflows, avalanches, or landslides;

— political events, civil unrest, or military actions;

— strikes and other protests;

— restrictions imposed by government authorities at the border of the Kyrgyz Republic.

6. Applicable Law and Dispute Resolution

6.1. Any disputes arising in connection with these Terms should first be resolved through discussion between the Client and KAGAN. If the parties cannot reach an agreement, the dispute will be handled in accordance with the laws of the Kyrgyz Republic.
